Stephen D. Potts

Partner

Stephen D. Potts is a partner at Herr, Potts and Potts, practicing in Special Needs Planning, Estate Planning, Estate and Trust Administration, Federal and State Income Tax, Real Estate, and Elder Law. He earned his B.A. from Franklin and Marshall College in 1999 and his J.D. from the University of Pittsburgh School of Law in 2002. Actively involved in his community, Steve has served on the boards of Bournelyf Special Camp, Kencrest Services and the ARC of Chester County.

Marilyn S. Mitchell

Partner

Marilyn S. Mitchell is a partner at Herr, Potts and Potts, focusing on Estate Planning, Estate and Trust Administration, Special Needs Planning/Guardianships, and Orphans’ Court Litigation. She earned her B.A. from Duke University in 2003 and her J.D. from The Marshall-Wythe School of Law at the College of William & Mary in 2007. Before joining the firm, Marilyn served as a prosecutor at the Chester County District Attorney’s Office for seven years and resides in West Chester, Pennsylvania, with her husband and their son.

Elizabeth Killackey

Attorney

Elizabeth Killackey is counsel at Herr, Potts and Potts, focusing on Estate Planning, Estate Administration, Special Needs Planning—including Special Needs Trusts and Guardianships—and Elder Law. She earned her B.A. from Swarthmore College and her J.D. from Villanova University School of Law, where she was a member of the Executive Committee of the Moot Court Board. Actively involved in her community, Elizabeth has volunteered at Wills for Seniors clinics in Montgomery County, served on the Board of the Old Eagle School House, and currently serves on the Advisory Board and Programs Committee of FLITE (Foundation for Learning in Tredyffrin-Easttown).

Elizabeth M. Bevenour

Associate

Elizabeth M. Bevenour is an associate attorney at Herr, Potts and Potts, practicing in Estate Planning, Estate and Trust Administration, Special Needs Planning/Guardianships, and Orphans’ Court Litigation. A native of Hockessin, Delaware, she graduated cum laude from the University of Delaware in 2015 and earned her J.D. from Delaware Law School in 2018. Before joining the firm, Elizabeth served as a Judicial Law Clerk in Delaware Family Court for three years and now resides in Wilmington, Delaware.

Our History

Herr, Potts and Potts was founded in Philadelphia by Philip C. Herr after he left his position as a prosecutor for the Pennsylvania Banking Department. In his dual capacity as attorney and CPA, he joined his father John P. Herr in 1939 concentrating on legal and accounting matters. His son, Philip C. Herr, Jr., joined the firm in 1961 to create the firm Herr and Herr. In 1972, John H. Potts joined the firm to create Herr, Potts and Herr. In 1990 the firm moved from Philadelphia to Radnor in Delaware County. In 1996 the firm moved to the Strafford Office Complex in Wayne (right behind the Wayne Farmers Market). Stephen D. Potts joined the firm in 2002 and became a partner in 2005. Marilyn S. Mitchell joined the firm in 2015 and became a partner in 2021.
